The residual distribution of the setttlements to eligible Third-Party Payor class members are scheduled to be mailed on January 22, 2021. Please allow at least 10-business days from the date of mailing for the checks to arrive at your address of record.
The Courts have approved the distribution of the settlements with Immucor, Inc. (Immucor) and Ortho-Clinical Diagnostics, Inc. (Ortho) and payments are scheduled to be mailed on December 5, 2019. Allow at least 10-business days for the check to arrive at your address of record.
If you purchased Traditional Blood Reagents directly from Defendants between January 1, 2001 and October 19, 2015, a class action settlement and distribution of two class action settlement funds may affect you.
In this class action lawsuit that was recently dismissed in the United States District Court for the Eastern District of Pennsylvania, the Plaintiffs allege that certain manufacturers conspired to fix Traditional Blood Reagents prices in violation of federal antitrust law. The lawsuit claimed that, as a result of Defendants’ alleged conduct, the prices paid by individuals and entities for Traditional Blood Reagents were higher than they otherwise would have been. The lawsuit seeks triple the amount of actual damages, attorneys’ fees and costs from Defendants. Defendants have denied the allegations of price fixing. Defendants have also denied that they are liable for any damages, attorneys’ fees, or costs but chose to settle this matter in order to avoid further litigation cost.
There were prior notices regarding this lawsuit. The purpose of this website is to inform you of new developments:
- A Settlement has been entered into with the remaining Defendant in the case, Ortho, for $19.5 million. A copy of the Notice is available on the Ortho Settlement Court Documents page on this website.
- The courts have approved both the Ortho and Immucor Settlements, which concludes these litigations and funds from these settlements will be distributed in late 2019.
In 2012, Immucor settled the lawsuit and paid $22,000,000 for the benefit of a class of purchasers of Traditional Blood Reagents. The Court entered final approval of the Immucor settlement and dismissed Immucor as a Defendant. For more information regarding the Immucor settlement, please click here.
On October 25, 2018, the Court entered final approval of the Ortho settlement and dismissed them as a Defendant. For information regarding the Ortho settlement, please click here.
